§ 22-5.2. Permit.

    Application; Issuance . Permits for the doing of work provided for in the preceding subsection, including cement and concrete curbs, gutter ways, sidewalks, driveways, and culverts may be obtained from the City Superintendent of Streets upon written application and shall set forth a description of the work with respect to which the application is made, together with the location thereof and the respective names and addresses of the applicant and of the person for whom the same is to be done; and if the applicant has within two (2) years prior to the date of making such application, complied in all respects with the terms of this article respecting registration and filing of the bond, it shall be the duty of the Superintendent of Streets to issue in writing a permit for the doing of the work; provided, however, that the Superintendent of Streets may refuse to issue the permit so sought if it shall appear that the applicant has at any previous time done any cement or concrete work of any kind or description upon any of the public places in the City defined in the preceding subsection, which, either through the use of improper materials or through poor workmanship, or through improper installation, has proved to be faulty or defective and which, upon notice of such fault or defect, the same applicant has refused or neglected to reconstruct or repair in a satisfactory manner.

    b.

    Permit Fee and Penalty .

    1.

    Prior to and as a condition of the issuance of a permit under the terms of this article, the applicant shall pay a sum per address for which a permit is issued. The permit fee shall be set by City Council Resolution.

    2.

    Where work is started without a permit, the applicant shall pay an additional penalty fee per address for which a permit is issued. The penalty fee shall be set by City Council Resolution.

    c.

    Notice to Owner; Form . Whenever any permits have been taken out as aforementioned, the Superintendent of Streets shall immediately mail to the person or persons for whom the work is to be done, to the address or addresses given in the application, a notice requiring, in substance, that such person have such work examined and declared satisfactory by the Superintendent of Streets before paying for the same.
